TMDLsThe Florida Department of Environmental Protection’s Division of Water Resource Management uses a comprehensive approach to protecting Florida water quality involving basin-wide assessments and the application of regulatory and non-regulatory strategies to reduce pollution. The Total Maximum Daily Load (TMDL) program is the heart of this comprehensive approach. (From the FDEP website.)The PBC MS4 NPDES third term permit continues to include TMDL requirements and a schedule for developing an implementation plan to reduce the discharge of pollutants from each permittee's MS4 to the maximum extent practicable. Both FDEP and EPA have identified impaired waterbody segments within Palm Beach County. Impairments include bacteria, dissolved oxygen, nutrients, and fecal coliform. Both FDEP and EPA are working on developing TMDLs and waste load allocations for the impaired waterbody segments. The MS4 3rd Term Permit requires that permittees prioritize TMDLs that were adopted by DEP or established by EPA on the effective date of the MS4 NPDES permit(March 2, 2011). Any TMDLs adopted or established after the permit’s effective date will be addressed in the next permit cycle. When the current MS4 permit was issued there were no adopted FDEP TMDLs. However, EPA had established seven TMDLs in Palm Beach County. Reports on EPA’s established TMDLs can be found at: http://www.epa.gov/waters/tmdl/expert_query.html. Although zero percent reduction is listed for some TMDLs, the water quality for these waterbodies was determined to be impaired for turbidity, and the established TMDL must be met. The flow chart below provides a schematic of the process to follow in order to develop a prioritization schedule, and monitoring assessment activities leading to an implementation plan. The timeline in the flow chart is based on the effective date of the permit. A map depicting the WBID boundaries, along with municipal and county boundaries can be downloaded here. EPA established TMDLs can be accessed at: http://www.epa.gov/region4/water/tmdl/florida/. For the third term permit a draft TMDL Prioritization Report was submitted to FDEP and can be downloaded here. FDEP's comment letter on the Prioritization Report can be downloaded here. The following table lists the TMDLs established or adopted since March 2, 2011. These will be addressed in the next MS4 NPDES permit term (Term 4).
